1. The parties agree to attempt to settle their dispute through the mediation process on the terms contained in the agreement. 2. The parties acknowledge and agree that mediation is a confidential settlement process, and that they are participating in the process with the understanding that anything discussed in the mediation process cannot be used in any proceedings. 3. During the mediation process, the mediator may disclose to either party any information provided by either party, unless the disclosing party has specifically requested the mediator to keep the information confidential. 4. The mediator will not disclose to anyone who is not a party to the mediation anything said, or any material submitted to the mediator except: a. To the lawyers or other professionals retained on behalf of the parties or to non-parties consented to in writing by the parties, as deemed appropriate or necessary by the mediator; b. For research or education purposes, on an anonymous basis; c. Where ordered to do so by a judicial authority or where required to do so by law; d. Where the information suggests that there will be an actual or potential threat to human life or safety or the commission of a crime in the future. 5. At no time will any party summon, subpoena, or seek access to any documents prepared for or in connection with the mediation, including but not limited to, any records, notes or work product of the mediator. 6. The mediator is Natalie Matias. 7. The mediator's role is to assist the parties to negotiate. The mediator will not make decisions for the parties about how the matter should or must be resolved. 8. The parties or those representing them at the mediation will have full, unqualified authority to settle the controversy. 9. Each party's participation in the mediation is voluntary. While each party intends to participate in the mediation to attempt to reach a settlement, any party or the mediator may withdraw from the mediation at any time for any reason. 10. The cost of the mediation is $000.00 for the first three hours and $00/hr. for each hour thereafter. This cost is split equally among the parties. 11. Each of us has read this agreement and agrees to proceed with the mediation on the terms contained herein.
